TERMS AND CONDITIONS

1. General

These Terms and Conditions (“Terms”) govern the purchase of all goods, custom-printed packaging, and stock items supplied by Mackole Packaging (“we,” “our,” or “us”) via mackolepackaging.com.au. By placing an order, approving a quote, or submitting artwork to us, you (“Client,” “Customer,” or “Buyer”) agree to be bound by these Terms.

2. Custom Artwork, Digital Proofs & Color Accuracy

  • Artwork Submission: Clients must provide artwork in vector formats (.AI, .PDF, or .EPS) with all fonts outlined.

  • Proof Approval: Digital artwork proofs will be provided for custom-printed orders (e.g., custom coffee cups, PET drinkware, or boxes). Production will only commence upon receiving written proof approval via email or signature.

  • Errors Post-Approval: Mackole Packaging is not liable for spelling, design, placement, or structural errors in final printed products if the error was present in the approved digital proof.

  • Color Tolerances: While we strive for exact PMS color matching, slight variations in color, ink density, and finish may occur between digital screens, proof prints, and physical production runs due to substrate absorption differences.

3. Production Lead Times & Quantity Variances

  • Lead Times: Estimated production and delivery lead times provided on quotes or proofs are estimates only. While we make every effort to meet agreed dispatch dates, Mackole Packaging is not liable for delays caused by third-party freight carriers, customs holds, or supply chain disruptions.

  • Production Overruns/Underruns: Due to the technical nature of custom packaging manufacturing, custom-printed orders are subject to an industry-standard quantity tolerance of +/- 5% to 10%. The final invoice will reflect the exact quantity manufactured and delivered.

4. Pricing, Quotes, and Payment

  • Pricing Currency: All prices quoted on mackolepackaging.com.au are in Australian Dollars (AUD) and are exclusive of GST unless explicitly stated otherwise.

  • Quote Validity: Written quotes provided by Mackole Packaging are valid for 30 calendar days from the date of issue.

  • Payment Terms: Full payment is required upon order placement or prior to dispatch unless approved B2B credit terms have been established in writing. Payment processing is handled via certified payment gateways (e.g., Stripe, PayPal, or Direct EFT).

5. Shipping, Delivery, and Risk of Loss

  • Delivery: We deliver across Australia via third-party freight and courier networks.

  • Risk: Risk of loss or damage to goods passes to the Buyer upon delivery to the nominated shipping address or collection by the customer’s carrier.

  • Delivery Issues: Customers must inspect all shipments immediately upon receipt. Any shortages, freight damage, or carton damage must be reported in writing within 48 hours of delivery.

6. Returns, Refunds, and Australian Consumer Law (ACL)

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).

  • Custom Printed Goods: Because custom packaging is manufactured specifically to your specifications, returns, exchanges, or refunds for “change of mind” are strictly not permitted once production has commenced.

  • Defective Products: If a product is defective, damaged, or fails to meet reasonable quality standards under ACL, you must notify us within 14 days of receipt with photograph/video evidence and batch details. If verified as defective, we will, at our discretion, replace the affected items, issue a credit, or process a refund.

7. Intellectual Property

The Client warrants that they own or hold all necessary copyright, trademark, and intellectual property permissions for any logos, designs, or artwork submitted for custom printing. The Client agrees to indemnify Mackole Packaging against any claims, losses, or legal costs arising from trademark or copyright infringement related to supplied artwork.

8. Limitation of Liability

To the maximum extent permitted by Australian law, Mackole Packaging shall not be liable for any indirect, incidental, special, or consequential damages—including loss of business profits, revenue, or commercial reputation—arising out of or in connection with the supply, delivery, or use of our packaging products.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising from these Terms or transactions on mackolepackaging.com.au shall be subject to the exclusive jurisdiction of the courts of Victoria.
